Welcome to Burger Me!. These Terms & Conditions (“Terms”) govern your access to and use of our website and related online features (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Our Privacy Policy explains how we handle personal information and is incorporated by reference into these Terms.
1. Website use
The Site provides general information about Burger Me! restaurants, menus, locations, careers, catering, parties, and ways to order. Content is for informational purposes and may change without notice. You must be at least the age of majority in your jurisdiction (or have parental permission where required) to use the Site and submit forms.
2. Menus, hours & pricing
Menu items, descriptions, prices, hours, and availability may vary by location and day. Online menus are approximate and may not reflect last-minute 86’s, seasonal swaps, or local promotions. Tax, fees, and tips (where applicable) are shown at checkout or in-restaurant. We reserve the right to correct errors and refuse or cancel orders when necessary.
3. Online orders
Orders placed through embedded or linked third-party platforms (such as DoorDash Storefront, Heartland, or another provider we select) are subject to that provider’s terms, pricing, fees, delivery rules, and refund policies—in addition to any Burger Me! policies that apply at the restaurant.
- You are responsible for providing accurate contact, pickup, and delivery information.
- Estimated ready or delivery times are estimates only.
- Payment is processed by the ordering/payment provider; we do not store full card numbers on this Site.
- Questions about refunds or delivery issues should usually start with the ordering provider and the location that fulfilled the order.
4. Catering, parties & other forms
Submitting a catering request, party reservation inquiry, contact message, or job application does not guarantee availability, pricing, or employment. We will follow up based on the information you provide. Final event details, deposits, cancellation rules, and confirmations (if any) will be communicated separately by our team.
5. Allergens & dietary information
We prepare food in kitchens that handle common allergens (including but not limited to dairy, eggs, wheat/gluten, soy, tree nuts, peanuts, fish, and shellfish). Cross-contact may occur. Menu descriptions on the Site are not a substitute for speaking with our team about allergies or dietary needs. If you have a severe allergy, please discuss it with the location before ordering.
6. Intellectual property
The Burger Me! name, logos, slogans, menu names, photography, graphics, and Site design are owned by Burger Me! or its licensors. You may not copy, scrape, republish, or commercially reuse Site content or brand assets without our prior written permission, except for limited personal, non-commercial viewing of the Site as intended.
7. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to systems, accounts, or data
- Interfere with or disrupt the Site or its infrastructure
- Upload malware or harmful code
- Scrape or harvest content or personal data at scale without permission
- Submit false, harassing, or fraudulent form content
- Impersonate Burger Me!, our team, or another person
We may suspend or block access if we reasonably believe these Terms have been violated.
8. Third-party links & tools
The Site may link to or embed third-party websites, maps, social networks, and ordering tools. We do not control those services and are not responsible for their content, availability, or policies. Your use of third-party services is at your own risk and subject to their terms.
9. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BURGER ME! DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT IS COMPLETE OR CURRENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BURGER ME! AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SITE OR THIRD-PARTY ORDERING TOOLS.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) FOR THE SPECIFIC ONLINE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in these Terms limits liability that cannot be limited under applicable law (including certain consumer rights).
11. Indemnification
You agree to defend, indemnify, and hold harmless Burger Me! and its owners, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right—except to the extent caused by our willful misconduct.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where mandatory local law in Nevada or another jurisdiction requires otherwise for a particular restaurant visit or order. Courts located in California (or, for Nevada location matters, an appropriate Nevada venue) may hear disputes arising from the Site, subject to applicable consumer venue protections.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by law. If a change is material, we may provide additional notice on the Site.
